This legal move comes in response to conflicting rulings from federal appeals courts regarding how these modern wagering platforms should be classified and governed. While the Third Circuit previously determined that sports-related prediction contracts qualify as financial swaps under the exclusive jurisdiction of the federal Commodity Futures Trading Commission, the Ninth Circuit recently reached the opposite conclusion, asserting that such sports wagers are simply gambling activities operating under a different label.\n\nIn its petition, New Jersey argues that allowing prediction platforms to bypass state-level gaming oversight would effectively federalize the multi-billion-dollar sports betting industry at the expense of established state laws. The state contends that if these contracts are indeed classified as federal swaps, it would logically follow that traditional, state-licensed casinos and sportsbooks have been operating in violation of federal financial regulations. By bringing this case to the nation's highest court, New Jersey aims to preserve state police powers over gambling and resolve a growing wave of litigation spanning multiple states over the boundary between federal commodities regulation and local consumer protections.
